The attached Declarations from two Malibu High School teachers includes evidence from 33 other Malibu High School teachers that the Santa Monica Malibu Unified School District (SMMUSD) is not complying with their Best Management Practices (BMPs) and is in violation of the EPA Region 9’s guidelines.

The attached declaration from Malibu High School Parent Matt DeNicola declares that former SMMUSD Board of Education member Ben Allen, now California State Senator Ben Allen admitted in September 2014 that the SMMUSD Board of Education chose not to test for PCBs, because they knew that they would find illegal levels of toxic PCBs and be forced to remove them under the TSCA. Dear Superintendent Lyon and SMMUSD Board,
Although it has been unsuccessfully asked of you many times before, the community is again requesting an urgent town hall meeting in Malibu to discuss your plan to immediately remediate the most-recent PCB results that show 31 new violations of Federal law that put students and teachers at risk. This is an urgent matter as registration deadlines for many schools is the end of January and parents must decide if they will registrar their kids in Malibu or other schools.
Also we are again asking you to immediately relocate the students, teachers and staff to portable units to keep them safe while you properly test the building materials and remediate.
EPA-certified PCB test results sent by Congressman Ted Lieu to EPA Administrator Gina McCarthy outline 31 more violations of Federal law (above 50 ppm) in 25 additional classrooms, now totaling 37 across the Malibu High School and Middle School campus. This includes four rooms that were purported by you to have been fully remediated this past summer but as tests indicate, this was not done properly.
Your response to this has not been, “Oh my, there are still toxic PCBs in Malibu. Let’s protect the students and teachers from high levels of toxic PCBs”, but instead, “Let’s attack the messenger by filing a police report alleging vandalism related to independent testing.” As you are well aware from the beginning, extracting a 1/2-inch sliver of 62-year old PCB contaminated caulking is not vandalism and now the Los Angeles District Attorney has determined that there is no crime and no damage.
It’s been more than two years since this topic became public, and you have all refused to put PCBs on the board agenda for a vote and discussion with the community, let alone a public discussion among the board in a public setting. This at a minimum is a failure in our democratic governing, at most a violation of California law.
Superintendent Lyon, Assist. Superintendent Jan Maez, and Laurie Lieberman have made decisions to spend nearly $7 million ear-marked for students, and also decided— without a board vote— to pursue criminal action against parents and teachers to advance their legal position in attempt to evade compliance with Federal law—a law meant to protect the health of children and teachers. This behavior is unacceptable for superintendents.
Why are you spending $7 million dollars to avoid spending $100,000 to properly test and identify the extent of contamination that would cost an estimated $1-$2 million to remove? (this estimate is in line with your own spend per remediated room last summer, as you spent approx. $25000 per room to remediate (see Environs declaration)) Why have you wasted over $ 5 million and continuing to spend more money that is very much needed by the students in Santa Monica and Malibu?
It has been two very long years for parents, students and teachers in Malibu. It is now time for you to take the very simple and fiscally responsible actions we have asked for all along — or it is time for a new superintendent and new board members who will better value taxpayers’ hard-earned money and the health and safety of our children, teachers and staff?

CURRENT HEALTH ISSUES WITH STUDENTS AND TEACHERS AT MALIBU SCHOOLS
• 6 teachers with thyroid cancer;
• 4 alumni (28-year-old)with thyroid cancer;
• 1 current student with thyroid disease, possible thyroid cancer
• 25 teachers with thyroid disease (including 14 of 30 Malibu Middle School teachers);
• 10 alumni in their 20s with thyroid disease;
• 1 alumni (22-year-old) with environmentally induced melanoma;
• 2 current teachers with environmentally induced melanoma;
• 1 teacher hospitalized from an environmentally-induced rash;
• 1 current student with an environmentally-induced rash lasting several months
• innumerable cases of headaches; persistent rashes; daily migraines; infertility issues; hair loss; immune issues; respiratory issues; and diabetes.
There is a statistically significant “relationship” between spending your days at Malibu High School and Thyroid Cancer.
“There is no safe level of PCBs. All they do is cause harm. They increase the risk of a great number of diseases, and the one that’s of most significance in a school is that they’re known to reduce cognitive function — learning and memory. And that’s the last thing you want in a school.” David O. Carpenter, M.D., director of the Institute for Health and the Environment at the University at Albany.
“PCBs are dangerous chemicals … even low concentrations of PCBs in air constitute an important route of exposure and disease, especially if the exposure is prolonged,” Dr. David Carpenter, director of the Institute for Health and the Environment at the University at Albany-SUNY.
The Santa Monica Malibu Unified School District’s Superintendent Sandra Lyon has spent over $6.5 million tax payer dollars to avoid a proper investigation and remediate all of the illegal levels of PCBs.
The SMMUSD appears to be more interested in attempting to limit their exposure to liability from a toxic tort complaint, rather than to just simply comply with the TSCA, and protect its students and teachers from this continuing harm.
The Santa Monica-Malibu Unified School District has thereby put the health of their students and teachers at risk.
IT’S TIME TO FIRE THE SANTA MONICA MALIBU UNIFIED SCHOOL DISTRICT’S SUPERINTENDENT SANDRA LYON
