Up to 14 Million Students in 26,000 U.S. Schools Are Exposed to Unsafe Levels of PCBs.

PCBs, or polychlorinated biphenyls, have been linked to cancer, harm to the immune system, neurological damage, learning deficits, lowered birth weight and decreased thyroid function.

Schoolchildren are most often exposed by old, PCB-laden caulk and crumbling fluorescent light fixtures. They may also come in contact with PCBs that leached into soil, or that were incorporated into paints and floor finishes. Any school building constructed between the 1950s and the late 1970s is likely to test positive for PCBs, but the EPA does not currently require such tests.

How likely is it that there would be three Thyroid Cancer diagnoses within a calendar year from a group of approximately eighty people (an estimate of the employees working full time in the Malibu High School buildings), while assuming that the probability of being diagnosed is the same as it is for the U.S. population in general? (The three teachers with thyroid cancer all taught in classrooms with toxic illegal levels of PCB in caulk or with wipe samples considered “PCB Contaminated” under the PCB Regulations. As of today, at least three student alumni have also been diagnosed with thyroid cancer. There are also at least 14 known cases of thyroid disease among teachers, and three cases of melanoma or pre-melanoma (a cancer which is also associated with exposure to PCBs) among teachers and former teachers, as well as other serious health problems.)

The definitive source for Cancer diagnosis rates in the U.S. is the (“SEER”) database of the National Cancer Institute. According to SEER, The number of new cases of Thyroid Cancer is 12.9 per 100,000 men and women per year. We will use the number 0.000129 as the probability that an adult is diagnosed with thyroid cancer in a particular year.

A common problem in statistics is figuring out the odds of a particular outcome, such as getting exactly 3 “heads” out of 80 coin flips, when repeatedly flipping a weighed coin of known probability. Rather than bore you with the foundational work needed in the explanation, let me just jump to the solution: the Binomial Distribution Formula, which you can google yourself for background. It shows the odds of getting an exact number of “success” results, in our case 3 out of 80 repeated trails, where the probability of an individual “success” is know to be 0.000129. It is ironic to call getting a diagnosis of thyroid cancer a “success,” but this is the language of the many free online “Cumulative Binomial Calculators” which are available. The term “cumulative” refers to expressing the results as “3 or more” – rather than “exactly 3.”

Plugging in 80 for the “number of trials,” 3 for the “number of successes,” and 0.000129 for the “probability of success” you get: 0.00000018. That is less than 1 in 5.5 million. To put it into perspective, this is less likely than flipping a fair coin 22 times and getting heads each and every time.

Getting one Thyroid Cancer diagnosis out of eighty people in a year would happen roughly one percent of the time (1 in 97). This alone could be used to argue that the null hypothesis of “no relationship” is false, as the rejection level is usually set at either 5 percent or 1 percent. Getting 2 diagnoses drops the odds to 1 in over 18,000. Getting 3 or more drops the odds to 1 in over 5,500,000. To me, there is no question about whether the results are “surprising.” They are. There is no question about whether the results are “statistically significant.” They are.

These findings demonstrate that there is a statistically significant “relationship” between spending your days at Malibu High School and Thyroid Cancer. We all need adequate answers about the nature of that relationship, and some sense that it has been adequately addressed. In their July 27, 2014 release, SMMUSD indicates that PCB levels are safe now, and were safe prior to testing. If true, all that tells me is that we haven’t found what we are looking for yet. Hopefully the search for the “relationship” continues until it is identified and remedied.

The City of Malibu through Resolution No. 14-58 requests that the Santa Monica-Malibu Unified School District (SMMUSD) conduct further source testing for polychlorinated biphenyls (PCBs) at all Malibu school campuses and in all rooms. Every inch of caulking does not need to be tested to verify there are PCBs. It is reasonable and based on standard building practices is responsible to assume that all like caulking in the same building contains PCBs.

Despite the October 2013, January 2014 letters, and City of Malibu passing this Resolution, the SMMUSD refuses to relocate its students and teachers and administer any further testing, even turning down the offer of Malibu parent and supermodel Cindy Crawford to personally pay for the tests. The EPA, in the Oct, 31st, 2014 approval, made very clear that PCBs over 50ppm cannot be left in place. PCBs are not like lead paint and asbestos; they are not chemically the same nor are they handled by EPA the same way.

The parents and teachers believe that further testing will demonstrate that PCB contamination is wide-spread and that the only solution both to protect kids and teachers and to comply with the law is a thorough investigation to identify and remove all PCBs found to be at illegal levels. In addition, they continue to criticize district testing practices such as leaving windows and doors open for a full day before doing air testing, as well as pre-cleaning surfaces before wipe tests as a way to manipulate results.

ON OCTOBER 24, 2015 AMERICA UNITES FOR KIDS RELEASED ADDITIONAL DISCOVERY CONCERNING SUPERINTENDENT SANDRA LYON

In 2013-14, Superintendent Sandra Lyon did not tell Malibu High School teachers and parents that their children were occupying classrooms that the previous teacher just reported having thyroid cancer as well as other previous teachers also having cancer.

These rooms then tested at 570,000 ppm of PCBs! The highest level ever found in the NATION!

The SMMUSD appears to be more interested in attempting to limit their exposure to liability from a toxic tort complaint, rather than to just simply comply with the TSCA, and protect its students and teachers from this continuing harm.

On Tuesday, December 16th, 2014, the SMMUSD ordered a “special” cleaning of the classrooms prior to Environ testing the dust and air. They asked teachers to remove all items from all surfaces so they can send a “special” crew to remove dust from surfaces; the same surfaces that Environ will be wipe testing hours later.

This renders PCB results meaningless. The goal of wipe and air testing is to see what the students and staff have been exposed to for the past 4 months. However, if they clean it hours before testing then any evidence of PCB exposure is removed.

This was done to guarantee the results are below EPA guidelines. Sadly, these test results will be nothing more than a PR move by the district to reassure parents and waste taxpayer dollars.

New test results posted by the Santa Monica-Malibu school district (SMMUSD) show nine classrooms and other facilities containing toxic polychlorinated biphenyls (PCBs) in concentrations up to 11,000 times above federal safety limits. The revelation came a day after America Unites for Kids and Public Employees for Environmental Responsibility (PEER) sued the Santa Monica Malibu Unified School District for violating the federal Toxic Substances Control Act by refusing to remove PCBs over 50ppm.

The new test results prepared by the district’s own consultant showed PCB levels ranging from 330 parts-per-million to 570,000 ppm, meaning that over 50% of the caulk sample was pure PCB, a cancer-causing, banned chemical. By contrast, the federal safety limit is just 50 ppm. Despite these extremely high levels of a highly toxic chemical banned by Congress, all of these rooms are still in use by students and teachers of the combined elementary, middle and high school campuses. Elementary school special needs students are occupying a classroom tested at 470,000 ppm.

The troubling nature of these ultra-high results is compounded by the manner of their release

America Unites and PEER had arranged independent testing of the caulking in these same rooms showing similar high levels. The district ignored these findings and only tested these rooms after the groups filed their Notice of Intent to Sue – and their own findings were much higher than the independent samples. Despite this verification, the district still opposes school-wide testing of the caulking;

At the school board meeting on March 19, 2015, the district’s own consultant, Douglas Daugherty of Environ, contended that independent tests could not be verified. In fact at that time, the consultant already had in his possession, test results reflecting PCB concentrations that were significantly higher.

“What school district officials have done is monstrous – they are deliberately keeping students and teachers in highly toxic classrooms with no precautions to prevent direct contact with PCBs,” stated PEER Senior Counsel Paula Dinerstein. “These results are the smoking gun evidence, from its own gun, that the district is in flagrant violation of the Toxic Substances Control Act.”

“I am stunned that district officials and their consultants stood in front of us on Thursday evening and did not disclose these extraordinarily high test results!” said Jennifer DeNicola, President of America Unites for Kids. “This illustrates to all of us that the district is going to stop at nothing, including withholding evidence, to defend their indefensible position to leave illegal levels of PCBs in the schools which put students and teachers in harm’s way.”

PCBs Affect a Whole Building, Not Just a Single Window

If PCB-laden caulking over 50ppm has been found in one classroom, then it is probable that PCB-laden caulk is in all classrooms in that building. It would be absurd to propose removal of only the tested window (which is what the district has proposed) when adjacent windows used the same caulking that contain high levels of PCBs.

The family alleges that on December 18, 2013, SMMUSD employee named Wendy Wax Gellis made a knowingly false referral to the Los Angeles Department of Children and Family Services (DCFS), and to local law enforcement that parent raped her own son. Complaint for Intentional Discrimination and Willfully Ignoring “Child Find Obligations” in Violation of Section 504, ADA, and UNRUH Civil Rights Act

The Santa Monica Malibu Unified School District has a demonstrated policy of intentional discrimination and deliberate indifference when it comes to educating students with known disabilities.

The Santa Monica Unified School District (SMMUSD) officials had policies of inaction that resulted in failures to provide adequate procedural safeguards and failure to train their staff.

The SMMUSD’s failure to execute its “child find” duty and evaluation obligations under Section 504 constituted intentional discrimination in that their failure to act was not just negligent; it was a deliberate choice to not act evidencing discriminatory intent.

That SMMUSD acted with deliberate indifference as shown by the facts that the SMMUSD had knowledge of facts tending to establish that Student had a suspected disability:

1) The SMMUSD had knowledge from which an inference could be drawn that a harm to Student’s federally protected right to be identified and evaluated under Section 504 was substantially likely to occur, and

2) The SMMUSD failed to act upon that likelihood when they refused to evaluate Student. These policies included failure to adequately and properly train school staff regarding compliance with their mandatory duties.

Through the policies of the Santa Monica Malibu Unified School District, the SMMUSD exhibited a deliberate indifference to the foreseeable consequences of the violations, including the foreseeable consequence of abuse of students with disabilities.

As a direct and proximate result of the Santa Monica Malibu Unified School District’s violations of law, Plaintiffs suffered out-of-pocket expenses and mental and emotional distress.

The SMMUSD appears to be more interested in attempting to limit their exposure to liability from a toxic tort complaint, rather than to just simply comply with the TSCA, and protect its students and teachers from this continuing harm.

The Santa Monica-Malibu Unified School District has thereby put the health of their students and teachers at risk.

Santa Monica-Malibu Unified School District’s Superintendent Sandra Lyon should be fired for not adequately protecting the School District’s students and teachers.
